These Terms of Service ("Terms") define the type, scope and conditions of provision of electronic services through the Pixel website and platform (the "Service").

The use of the Service requires prior acknowledgement and acceptance of these Terms. Failure to accept these Terms prevents you from using the Service.

The Service Provider reserves the right to restrict or block access to the Service if the User breaches these Terms or applicable laws. In such cases, the User will be notified immediately.
Registration and maintenance of a User Account are free of charge.
Registration requires providing an email address and creating a password. Users may also register using OAuth providers (Google, Facebook).
The User is responsible for maintaining the confidentiality of login credentials. The Service Provider is not responsible for consequences of sharing passwords with third parties.
Users may delete their Account at any time through the account settings or by contacting contact@pixel.bilberry.pro
The Service is currently provided free of charge. Users can access all AI image generation features without payment.
The Service Provider reserves the right to introduce paid subscription plans in the future. Users will be notified at least 30 days in advance of any such changes.
Current users who registered during the free period may receive special pricing or continued free access, at the Service Provider's discretion.
Generated Images: Users retain full commercial rights to all images generated using the Service. You may use Generated Images for any purpose, including commercial use, without restriction or additional licensing fees.
Service Content: The Service, including its software, design, logos, graphics, and other elements, is protected by intellectual property rights owned by the Service Provider. Users may not copy, distribute, or modify these elements without prior written consent.
Uploaded Images: Users warrant that they have the right to upload and process any images they submit to the Service. The Service Provider is not responsible for copyright infringement by Users.
Generated Images and uploaded content are stored for 30 days from the date of creation, after which they may be automatically deleted.
Users are responsible for downloading and backing up any Generated Images they wish to retain beyond this period.
Upon Account deletion, all associated data, including Generated Images, will be permanently deleted within 30 days.
The Service Provider endeavors to provide the Service continuously, 7 days per week, 24 hours per day.
The Service Provider reserves the right to suspend the Service temporarily for maintenance, updates, or repairs. Users will be notified in advance when possible.
The Service Provider is not liable for interruptions caused by force majeure, equipment malfunctions, power outages, Internet connection issues, or unauthorized interference by third parties.

Complaints will be resolved within 14 days of receipt, and Users will be notified of the resolution via email.
The Service Provider processes User personal data in accordance with the General Data Protection Regulation (GDPR) and applicable laws.
Personal data is collected and processed to enable Users to use the Service and for the purposes described in the Privacy Policy.

The Service is provided "as is" without warranties of any kind, express or implied.

Users use the Service at their own risk and are responsible for ensuring compliance with applicable laws.
The Contract may be terminated:
Upon termination, the User's access to the Service will cease, and all associated data will be deleted in accordance with section 8.
The Service Provider reserves the right to amend these Terms at any time.
Users will be notified of changes at least 14 days before the new Terms take effect, via email and through a notice on the Website.
Continued use of the Service after the effective date of changes constitutes acceptance of the new Terms. Users who do not accept the changes may delete their Account before the effective date.
These Terms are governed by the laws of Poland.
Any disputes arising from these Terms shall be resolved through amicable negotiations. If no agreement is reached, disputes shall be resolved by courts with jurisdiction over the Service Provider's location.

These Terms of Service are effective as of November 9, 2025.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the User and the Service Provider regarding the use of the Service.
